Why robust data residency matters

  • Regulatory alignment (GDPR). Keeping personal data in the EU reduces reliance on cross-border transfer tools and simplifies compliance reviews, because GDPR imposes strict conditions on transfers outside the EEA.

  • Lower transfer risk post-Schrems II. The CJEU’s Schrems II ruling invalidated Privacy Shield and requires “essentially equivalent” protection for any transfers, prompting tighter diligence on SCCs and third-country laws—hence the value of EU-only processing.

  • Established, lawful transfer fallback. When limited cross-border access is needed (e.g., support), using the European Commission’s Standard Contractual Clauses (SCCs) provides a recognized legal mechanism under GDPR.

AI endpoints and residency considerations

Standard AI endpoints: OpenAI (US data residency) or Microsoft Azure AI (US, EU or Canada data residency); data is used solely to provide NEXT AI features.

Enterprise customers may use customer-specific AI endpoints: ChatGPT Enterprise or Azure AI Enterprise.

Subprocessors

Relevant subprocessors and locations are listed on the subprocessors page, with DPA status and use cases.

International transfers

When limited data access outside your chosen region is necessary (e.g., support or vetted subprocessors), NEXT AI uses SCCs issued by the European Commission to safeguard transfers under GDPR.

Q: Can I choose exactly which AWS region hosts my data?

Yes. Business and Enterprise Workspaces can select an AWS region from the supported list to align with residency, compliance, and latency needs.

Q: What’s the default region if I don’t choose one?

Free Workspaces default to eu-west-1 (Ireland, EU). Business/Enterprise customers can choose their region during onboarding or via support.

Q: Do you support EU-only data processing?

Yes. Hosting in an EU region keeps data in the EU by default. EU-only hosting also includes the use of EU-only subprocessors. If any cross-border access is needed (e.g., support), transfers are safeguarded by SCCs.

Q: Why is EU-only data residency important for many enterprises?
